Tapeedimaailm OÜ Terms and Conditions

This is the English translation from the Estonian language of Tapeedimaailm OÜ Terms & Conditions. In case there are differences between the English and the Estonian version of the Terms & Conditions the latter shall prevail.

1. General Conditions

1.1 www.tapeedimaailm.eu (hereinafter Online Store) is the internet shop, created by Tapeedimaailm OÜ, registry code 12457704, located at Paldiski mnt 77, Tallinn, 10617, Estonia, through which products are sold.

1.2 These terms and conditions regulate the legal relations which arise when online store users buy products via the Online Store.

1.3 In addition to these terms and conditions, the existing legislation in the Republic of Estonia regulates the legal relations arising from purchasing via online store.

1.4 Tapeedimaailm OÜ reserves the right to improve and change conditions without notice. Orders that are made before the new terms take effect, are dealt on the basis of the conditions that were valid at the time of the order received.

2. Prices

2.1 Prices of all the products sold in the Online Store are shown in EUR and include VAT. 

2.2 Tapeedimaailm OÜ reserves the right to change prices without notice. When a Customer makes an order before the entry into force of the new prices, the prices which are reflected in his/her invoice will be valid for him/her.

3. Payment Methods

3.1 The customer can choose from the following payment methods: 
 
1) By bank transfer

2) Cash on delivery.

3.2 Your order and billing details are cancelled after 5 working days if you failed to pay

after receiving the "Order Confirmation" and/or invoice.

4. Delivery

4.1 While making an order, the Customer must enter his/her name, phone number and the terminal, from where he/she wants to receive the order.

4.2 The order is delivered to the terminal within the designated period of time, which is marked in the product information.

4.3 Displayed products with delivery time of up to 5 working days are usually in stock. In case if the order exceeds the inventory, the Online Store informs client about the delivery time prior to the order confirmation and payment.

4.4 In case of ordering several different products with different delivery time, the client must consider the longer delivery time.

4.5 If the product is to be ordered from the supplier, and it appears that the delivery time is different from the delivery time marked in product description, the employee of the Online Store informs about that the client by phone or e-mail within 3 business days from ordering/approval. If the customer declines the purchase due to the longer delivery time, then the entire order cost is returned to the customer´s bank account within  5 working days after the cancellation of the order,but not later than 20 working days after the order cancellation.

4.6 The postal services within Estonia are provided by one of the following delivery providers: Smart Post, Post24, Eesti Post for more details please their visit websites accordingly (www.smartpost.ee ; www.post24.ee ; www.post.ee )

4.7 The postal services outside Estonia are provided by Eesti Post (international postage), DHL, UPS, Cargobus, Itella Smartpost. For more details please their visit websites accordingly ( www.post.ee ; www.dhl.ee ; www.ups.com ; www.cargobus.ee; www.smartpost.ee

5. Refund Policy

5.1 The customer has the statutory right to examine the product and return it within 14 days, from the day the customer received the parcel from the parcel terminal.

5.2 Returned goods will be taken back only in original packaging, undamaged, unused, and in complete set. 

5.3 Without the original packaging the products will not be taken back, and they are returned to the customer only after the payment of additional transportation costs.

5.4 Purchased goods can be returned using any of the postal services provided above.

5.5 The Online Store will return only the cost of the returned items.

5.6 If the customer retreats on the agreement, the Online Store returns the product cost  to the client within 30 days from the day the Online Store receives the information about retreating on the agreement by the customer. The customer must return the products received from the Online Store as soon as possible,  but not later than 14 days after sending the information about retreating on the agreement.

6. Submission of complaints

6.1 The products that are bought via the Online Store are subject to VÕS § 218 p 2 of a 2-year claim submission deadline for deficiencies of the products at the moment of transfer. It also applies to claims submitted to latent defects, which occur after the transfer of products, but were caused by the facts, which were already at the time of transfer.

6.2 Tapeedimaailm OÜ is not responsible for:
1) the deterioration / damage of the product due to client's fault; 
2) defects, which occurred due to the irregular use of the product; 
3) normal depreciation which occurred due to the regular use of the product;
4) for defects, which occurred after the transfer of products, except in case of hidden defects.

Adding photos will speed up the review of the complaint.

6.3 Claims will be reviewed only if the Client presents the invoice (which was sent to the client´s email after checkout) together with the claim. Customer complaints regarding products can be sent also to  Tapeedimaailm OÜ at Paldiski mnt 77, Tallinn, 10617.

6.4 In case of Consumer sales it is expected that the non-compliance with the agreement terms that occured within six months after transfer, existed at the time of the transfer, if this assumption is not in the conflict with the character of product/defect. In this case, the Internet Shop is obliged to bear transportation and examination expenses, that are connected with the claim. In cases where the defect occurs after six months, the transportation and examination expenses are paid in accordance with the procedure and the examination result.

6.5 The Customer loses the right to request the repair or replacement from the Online Store, if the Customer does not require it at the same time when making a claim or complaint within a reasonable time after making a claim. This does not apply to consumer sales. 

7. Processing of personal data 

7.1 By ordering via the Online Store the Customer gives his/her consent to the processing of his/her personal data. 

7.2 The customer personal data, which become known when the client makes the order, is registered in Online Store database and used to fulfill orders and for marketing purposes, including sending customer related information. Personal data is sent to third parties only to extent it is necessary to fulfill the order and processed in accordance with the Personal Data Protection Act. The customer has the right to ask to change, correct or delete their personal data, except to the extent necessary to comply with the existing order.

7.3 Tapeedimaailm OÜ does not have an access to the payment related information. The Online Store redirects the Client to the secure environment of PayPal, where the necessary data is registrated to fullfill payment. 

7.4 The source of the personal data is the emergence of customer relationship during the customer registration process in the internet-shop. 

7.5 Customer´s personal data is provided to the transportion service supply company on the purpose to fulfill orders. 

7.6 The customer gives his consent to send email to customer with order-related information and the survey on the quality of service.

8. Responsibility and force majeure

8.1 Tapeedimaailm OÜ and the Client are responsible before another party for the damage caused by violation of these terms and conditions in the cases and to the extent regulated in the current legislation of the Republic of Estonia.

8.2 Tapeedimaailm OÜ is not responsible for any inconvenience or damage caused by the failure to comply with the order or by the delay of the order when the failure to comply with the order or the delay of the order is due to external circumstances beyond control of Wallex Designs OÜ.

9. Disagreements

9.1 The disputes between Tapeedimaailm OÜ and the Client shall be attempted to be resolved through negotiations on the basis of good will.

9.2 If Tapeedimaailm OÜ and the Client can not reach the agreement, the Client has the right to contact the agency for protecting the rights of consumer, which is provided by law of Republic of Estonia, or the courts.

9.3 Litigations shall be resolved only in Harju County Court.

10. Final Provisions

10.1 The product image is for illustrative purposes. For example, the colors of the wallpapers may be different from the colors on the picture due to the various properties or settings of screen displays.

10.2 Tapeedimaailm OÜ reserves the right to withdraw from the sale if, because of a technical glitch or human error, the product data entered is clearly very wrong. For example, entered product price is 1 euro instead of 100 Euro.
